TRUCK & TRAILER PARKING LICENSE AGREEMENT
Lot Operator: Blue & Yellow Trucking, LLC ("Operator"), 228 W 23rd St, Charlotte, NC 28206.
1. License, not a lease. Operator grants Customer a non-exclusive, revocable license to park one (1) commercial vehicle and/or trailer (the "Vehicle") strictly subject to this Agreement. No leasehold, tenancy, or bailment is created.
2. Term & renewal. Daily plans run for 24 hours from the start date. Monthly plans run for 30 consecutive days from the start date. All terms must be renewed online before expiration.
3. Fees. All fees are non-refundable once gate access is issued. Payment is processed by Square; Operator does not store card data.
4. Gate code. A personal gate code will be issued upon payment. Do not share, transmit, or post the code. Operator may revoke a code at any time for cause.
5. Use of the Lot. No mechanical work beyond minor pre-trip inspection. No fueling, hot work, painting, washing, dumping, hazardous-material handling, or repair. No abandoned trailers. No living in vehicles.
6. Insurance. Customer represents that the Vehicle and operator(s) maintain commercial auto liability and cargo insurance meeting or exceeding FMCSA minimums for the equipment parked.
7. Assumption of risk; release. Customer parks at sole risk. Operator is NOT a bailee and is NOT responsible for theft of, damage to, or loss of the Vehicle, trailer, contents, cargo, or personal property.
8. Indemnification. Customer shall indemnify, defend, and hold Operator harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of Customer's use of the Lot.
9. Limitation of liability. Operator's total liability under this Agreement shall not exceed the fees actually paid for the then-current term.
10. Removal & lien. Operator may immobilize, tow, or remove any Vehicle remaining past expiration or in violation. Removal, storage, and lien costs are Customer's responsibility.
11. Termination. Operator may terminate for cause and revoke the gate code immediately.
12. Electronic signature. A typed signature constitutes an electronic signature under E-SIGN (15 U.S.C. § 7001 et seq.) with the same legal effect as a handwritten signature.
13. Governing law & venue. North Carolina law governs. Venue: Mecklenburg County, NC.
14. Notices. Operator's address above; Customer's email on file.
15. Entire agreement. This Agreement is the entire agreement between the parties regarding parking at the Lot.
